By accessing or using the FunkyFolio services provided by FUNKYFOLIO LLC ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

These Terms apply to all users of our services, including visitors, registered users, and paying subscribers. By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

FunkyFolio provides AI-powered transcription, subtitle generation, meeting notes, and audio summarization services. Our services allow you to upload audio and video files for processing and receive text-based outputs.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We will make reasonable efforts to notify users of significant changes.

To access certain features of our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

You agree not to use our services to:

• Upload content that infringes intellectual property rights
• Transmit harmful, offensive, or illegal content
• Attempt to circumvent security measures or access restrictions
• Use automated systems to access our services without permission
• Interfere with the proper functioning of our services
• Violate any applicable laws or regulations

You retain all ownership rights to the content you upload to our services. By uploading content, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing our services.

We do not claim ownership of your content, and we will not use your content for training AI models without your explicit consent.

Paid subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees associated with your subscription.

Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy. You may cancel your subscription at any time, and it will remain active until the end of the billing period.

To the maximum extent permitted by law, FUNKYFOLIO LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.

Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve months preceding the claim.

You agree to indemnify and hold harmless FUNKYFOLIO LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

We may update these Terms from time to time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
